These Terms of Service (these “Terms”) are construed as a legal agreement between Falguni Mather Integrative Therapy Limited (“FMITL”) and you (the “Client”) which govern your use of the website located at https://falgunimather.com and any related services provided by FMITL.

By accessing https://falgunimather.com (the “Website”), the Client agrees that it has read and understood these Terms and additionally covenants to abide by these Terms and to comply with all applicable laws and regulations. These Terms provide complete details and rules in relation to the use and access of the Website.

Moreover, data may be collected from the Client through FMITL or a third party, details of which are specified in FMITL’s Privacy Policy available on the Website. It is hereby understood that in the event of non-compliance, violation or breach of these Terms, FMITL reserves the right to deny the Client access to the Website or for any further reason at FMITL’s discretion.

FMITL reserves the right to review and amend any of these Terms of Service at its sole discretion. Upon doing so, FMITL will update this page. Therefore, it is recommended to revisit these Terms from time to time in the event of any update. FMITL is not responsible nor obligated to inform the Client of any update, change, amendment or deletion. Any changes to these Terms of Service will take effect immediately from the date of publication.

Limitations of Use

By using this Website, you warrant on behalf of yourself, your users, and other parties you represent that you will not:

  7. use this Website in conjunction with sending unauthorised advertising or spam;

Intellectual Property

All content, materials, information, and intellectual property contained on this Website, including but not limited to text, graphics, logos, images, and digital materials (where applicable), are the exclusive property of FMITL or are used under licence, and are protected by applicable copyright, trademark, and other intellectual property laws.

The Client is granted a limited, non-exclusive, non-transferable licence to access and use the Website content solely for personal, non-commercial purposes in connection with the Services offered by FMITL. Any unauthorised use, reproduction, distribution, modification, or commercial exploitation of the Website content is strictly prohibited.

In the event FMITL discovers that the Client is using, has used, or intends to use any intellectual property or content from this Website for commercial benefit, personal gain, or is passing off related services in a manner likely to cause confusion or deception, FMITL reserves the right, in its sole discretion, to take appropriate legal and equitable action against the Client.

This licence shall automatically terminate upon any violation of these restrictions or these Terms, or in the event FMITL suspends or terminates the Client’s access to the Website or Services.

Liability

The Website, the Services, and all material, content and information provided on the Website or through the Services are provided on an ‘as is’ and ‘as available’ basis. To the extent permitted by law, FMITL makes no warranties, representations or guarantees, whether expressed or implied, and hereby disclaims and negates all warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement. In particular, FMITL undertakes no responsibility nor makes any guarantee as to the success, failure, outcomes, results or benefits of any Services provided, including but not limited to therapy sessions, workshops, trainings, courses, mentoring, or any other professional services. FMITL shall undertake its best endeavours to provide the Services as per the Client’s requirements, however, FMITL cannot assume responsibility or liability for any outcomes, results, or consequences arising from participation in or receipt of the Services.

The Client acknowledges and agrees that participation in any Services offered by FMITL, including but not limited to Emotional Freedom Techniques (EFT) therapy, trainings, workshops, courses, and mentoring programmes, is undertaken entirely at the Client’s own risk. The Client accepts full responsibility for any decisions made or actions taken as a result of participating in such Services.

In no event shall FMITL, its directors, officers, employees, contractors, or suppliers be liable for any direct, indirect, incidental, special, consequential, or exemplary loss or damages suffered or incurred by the Client or any third party arising from or in connection with: (a) the use of or inability to use this Website or the materials on this Website; (b) the provision of or participation in any Services; (c) any advice, guidance, instruction, or information provided through the Website or Services; (d) any outcomes or results (or lack thereof) from participation in the Services; or (e) any reliance placed on the content, materials, or Services provided by FMITL, even if FMITL or an authorised representative has been notified, orally or in writing, of the possibility of such loss or damage.

In the context of these Terms, “consequential loss” includes, without limitation, any indirect loss, real or anticipated loss of profit, loss of benefit, loss of revenue, loss of business, loss of goodwill, loss of opportunity, loss of savings, loss of reputation, loss of use, loss of contract, loss or corruption of data, and any economic loss, whether under statute, contract, equity, tort (including negligence), indemnity or otherwise.

Nothing in these Terms shall exclude or limit FMITL’s liability for death or personal injury caused by its proven negligence, fraud or fraudulent misrepresentation, or any other liability which cannot be excluded or limited under applicable law in Hong Kong. To the extent that any other limitation of liability set out in these Terms is prohibited by applicable law in Hong Kong, such limitation shall not apply.

Accuracy of Materials

The material, content and information available on the Website are general in nature and do not cover the complete scope of Services offered by FMITL.

FMITL makes no representations or warranties as to the accuracy, completeness, currency, or validity of any information, materials, or content available on the Website.

Third-Party Services and Links

Cancellation Policy

By booking a course, training, workshop or appointment, the Client agrees to the following cancellation terms:

Group Workshops, Courses Trainings:

  • Cancellations made more than 7 days prior to the course start date will be eligible for a 90% refund, with 10% retained as an administrative fee.
  • Cancellations made within 7 days but more than 24 hours prior to the course start date will be eligible for a 50% refund.
  • Cancellations made within 24 hours of the course start date are non-refundable.

Individual Appointments:

  • A minimum of 24 hours’ notice is required to cancel or reschedule an individual appointment. Cancellations made with less than 24 hours’ notice will result in the full session fee being charged.

Mentoring for Certification in EFT Programmes:

  • Clients enrolling in Mentoring for Certification programmes may withdraw within two months from the date of signing the agreement. Withdrawals made within this two-month period will be eligible for a 75% refund of fees paid, with 25% retained by FMITL as an administrative and programme setup fee to cover the work undertaken in establishing the certification pathway.
  • Withdrawals made after the two-month period are non-refundable.
  • For Clients on instalment payment plans, the refund calculation will be based on the total programme fee, less the 25% administrative and setup fee, with any refund due offset against instalments already paid.

FMITL may, at its sole discretion, make exceptions to this policy in cases of extenuating circumstances. By proceeding with a booking, the Client acknowledges and agrees to these terms.

Right to Terminate

FMITL reserves the right to restrict, suspend, or terminate the Client’s access to any services provided through the Website, including but not limited to account access or participation in courses, in the event of any breach or non-compliance with these Terms. FMITL may exercise this right by issuing a written notice to the Client.

Severance

In the event any clause of these Terms is deemed by a court of competent jurisdiction as void, null, illegal or unenforceable, the same shall be severed as if it was not a part of these Terms. The remaining clauses of these Terms shall continue to remain in full force and effect.

Governing Law

These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. In the event of any dispute out of or in connection with these Terms, the courts of Hong Kong shall have exclusive jurisdiction.
